Contested Divorce or Uncontested Divorce?
Most clients who come to us to talk about getting a divorce have a pretty good idea of whether it’s going to be a fight, or whether they will be able to agree on everything. That’s the basic difference between a contested divorce and an uncontested divorce. And our firm can help you out in either situation. And with the experience we have with divorce cases in Las Vegas, we are often able to turn a contested divorce into an amicable settlement.
What is a Contested Divorce?
In Nevada (or pretty much any other state), a court is required to resolve a few issues before a divorce is complete. First, the Court has to divide your assets and debts according to Nevada law. If you are going through a high-asset divorce, this can be much more complicated. Second, the Court should decide any child custody issues if minor children are involved. If you don’t have any minor children, you can skip this step! Finally, the Court has to decide spousal support and child support.
Now, if you and your soon-to-be-ex can agree upon all of these issues yourselves, then your divorce will not be contested. Your divorce should go through the much quicker “uncontested divorce” process, which normally takes a month or less. The advantage to an uncontested divorce is that it also costs less in attorney’s fees!
But occasionally, one side is not willing to agree to one or several issues. Until both sides are able to agree upon each of the issues stated above, they will have to submit to a determination by the court, which means the case is contested.
Whether you think your case will be contested, or uncontested, you should speak to an attorney who understands the law, and what you deserve out of your divorce. The Las Vegas divorce lawyers at McDonald Law Offices are here to help you with any questions you have, so contact us today at 702-385-7411.
Is a Contested Divorce worth it?
That is a tricky question. Quite often, we get a better result for our client if we can negotiate out a settlement. But we also know Nevada divorce law, and what will likely happen if a case goes to trial. If we think your spouse is trying to take advantage of you, we will advise you of your rights, and whether you should take your case to trial. Even if you think your spouse is being fair, it never hurts to talk to an attorney about your case, so give us a call.
At McDonald Law Offices, we use every method available to get you the best results out of your divorce. We will often propose a mediation, or settlement conference, with the other side to try to resolve your divorce case.
